1. About these terms
Foodysh platform is operated by [Registered company name] Private Limited ("Foodysh", "we", "us"). By creating an account or placing an order, you agree to these terms and to our privacy policy. If you do not agree, please do not use the platform.
We may update these terms from time to time. We will post the new version here and, for material changes, notify you in the app. Continuing to use the platform after a change means you accept it.
2. Our role
Foodysh is a technology platform that connects you with independent restaurants and food businesses ("restaurant partners") and independent delivery partners. Restaurant partners prepare the food and are responsible for its quality, quantity, hygiene, allergen information and compliance with the Food Safety and Standards Act, 2006.
We act as an intermediary under the Information Technology Act, 2000 and as an e-commerce entity under the Consumer Protection (E-Commerce) Rules, 2020.
3. Your account
- You must be at least 18 years old, or use the platform under the supervision of a parent or guardian.
- Provide accurate details, including a working mobile number and delivery address.
- Keep your OTP and login details private. You are responsible for activity on your account.
- Tell us straight away at support@thepureeats.com if you think your account has been misused.
4. Orders and pricing
Menu items, prices and availability are set by restaurant partners and may change. Before you pay, the checkout screen shows the item total, taxes, packaging charges, delivery fee and any platform fee. The amount shown at checkout is the amount you pay.
An order is confirmed only when the restaurant partner accepts it. A restaurant may decline an order, for example if an item is sold out. If this happens after payment, you will receive a full refund.
Veg and non-veg markings are provided by restaurant partners. If you have a food allergy, please check with the restaurant before ordering.
5. Payments
You can pay using UPI, debit or credit cards, net banking, supported wallets or cash on delivery where available. Online payments are processed by RBI-regulated payment partners. We do not store your full card details.
6. Delivery
Delivery times shown in the app are estimates and can be affected by traffic, weather and order volume. Please make sure someone is available to receive the order at the address given. If the delivery partner cannot reach you after reasonable attempts, the order may be marked as delivered and may not be eligible for a refund.
7. Cancellations and refunds
- You can cancel free of charge before the restaurant accepts your order.
- After the restaurant starts preparing your food, a cancellation charge of up to the full order value may apply.
- If your order is missing items, damaged, or significantly different from what you ordered, report it in the app within 24 hours with photos where possible.
- Approved refunds go back to the original payment method within 5 to 7 working days, or to your Foodysh wallet if you choose.
8. Offers and wallet
Coupons and offers have their own conditions, shown when you apply them. We may withdraw an offer or recover a discount if it was used fraudulently. Wallet balance cannot be transferred or withdrawn as cash except where required by law.
9. Acceptable use
Please do not misuse the platform. This includes placing fake orders, abusing restaurant or delivery partners, posting false reviews, scraping data, or trying to break our security. We may suspend or close accounts that break these rules.
10. Ratings and reviews
Reviews should reflect your own genuine experience. By posting a review, you give us a non-exclusive, royalty-free licence to display it on the platform. We may remove reviews that are abusive, misleading or unrelated to the order.
11. Limitation of liability
To the extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these terms limits rights you have under the Consumer Protection Act, 2019.
12. Governing law
These terms are governed by the laws of India. Subject to your rights as a consumer, courts at Nashik, Maharashtra shall have jurisdiction over any dispute.
13. Grievance redressal
If you have a complaint, contact our Grievance Officer: [Grievance Officer name], grievance@thepureeats.com. We will acknowledge your complaint within 48 hours and aim to resolve it within one month, as required by the Consumer Protection (E-Commerce) Rules, 2020.
